Terms of Service.

These Terms and Conditions (“Terms”) form the agreement between Forest Film (“the Photographer/Videographer”) and the Client for all photography and videography services. By booking a session through our website or Setmore booking page, you agree to these Terms.

1. Booking & Payments

1.1 All bookings are subject to availability and are confirmed once payment or deposit has been received.
1.2 For photography sessions, full payment is required at the time of booking.
1.3 For videography projects, a 50% deposit is required upon booking, with the remaining 50% due upon completion of filming and before delivery of any edited work.
1.4 Payments are accepted via the methods listed on our booking system or invoice.
1.5 For projects requiring travel beyond the local area, additional fees may apply to cover travel costs and, where necessary, accommodation. These will be discussed and agreed in advance, based on project location, start time, and duration.

2. Cancellations & Rescheduling

2.1 Clients may cancel or reschedule up to 48 hours before the booked session for a full refund or transfer of payment.
2.2 Cancellations or reschedules made within 24 to 48 hours of the booked time will incur a 50% fee.
2.3 Cancellations or no-shows made within 24 hours of the session will result in the full session fee being forfeited.
2.4 In the unlikely event that Forest Film must cancel due to illness, severe weather, or equipment failure, an alternative date will be offered or a full refund provided.

3. Deliverables & Editing

3.1 Each service lists a minimum number of deliverables (e.g. edited photos or video clips). This number is guaranteed as a minimum; additional files may be provided at Forest Film’s discretion.
3.2 All editing, grading, and selection of final images or clips are completed in Forest Film’s signature style, though adjustments can be made to suit the client’s creative preferences where discussed and agreed prior to editing.
3.3 RAW or unedited files will not be supplied under any circumstances.
3.4 Delivery timelines vary by project type but will be communicated at the time of booking.

4. Usage Rights & Copyright

4.1 Forest Film retains full copyright and ownership of all images and video footage produced.
4.2 The Client is granted a non-exclusive licence for personal or business promotional use of the final deliverables.
4.3 The Client must not sell, edit, or redistribute the work without prior written consent.
4.4 Forest Film reserves the right to use selected images or clips for portfolio, website, and promotional purposes unless the Client requests otherwise in writing before the session.

5. Conduct & Cooperation

5.1 The Client is responsible for securing necessary permissions or access to locations.
5.2 If the shoot is delayed or restricted due to issues beyond Forest Film’s control (e.g. late arrivals, weather, venue access), Forest Film reserves the right to adjust coverage or fees accordingly.
5.3 The Client agrees to ensure all participants behave respectfully during shoots.

6. Liability & Equipment

6.1 Forest Film is fully insured for public liability and professional indemnity.
6.2 In the event of unforeseen technical failure, injury, or other circumstances beyond control, liability shall be limited to the return of all payments received.

7. Delivery & File Storage

7.1 Final deliverables will be provided digitally via download link or online gallery unless otherwise agreed.
7.2 Files are stored for 2 months after final delivery. After this period, backups are not guaranteed and may be permanently deleted. Clients are advised to make their own backups promptly upon receipt.

8. Privacy

8.1 Client details, images, and contact information will be used solely for booking, communication, and portfolio purposes as agreed.
8.2 Forest Film complies with UK GDPR data-protection requirements.

9. Agreement

By booking a session, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
Any modifications must be made in writing and agreed upon by both parties.
